1. What are motor vehicle points?

Motor Vehicle Services (MVS) tracks your driving behavior by adding points to your record when you are convicted of a moving violation. The more serious the violation, the more points you are assessed. The schedule below shows a list of violations and their point values. MVS points are completely separate from the insurance eligibility points used by NJ Department of Insurance to assess surcharges on insurance payments

2. Will I receive a notice telling me how many points I have?

During the first two years that you are licensed, you're on probation and will receive an advisory notice when you commit your first point violation. If you receive two or more violations totaling four or more points, you must complete the Probationary Driver Program.

After that, MVS will send advisory notices whenever points assessed violations are added to your driving record and the point total is 6 to 11.

3. How many points on my driver's license will suspend my driving privileges?

Once a driver receives 12 or more points on your driving record, MVS will issue a notice of scheduled suspension of your driving privilege.

4. How can I remove points from my driving record?

Up to three points will be subtracted from your point total for every year of safe driving (no violations or suspensions). But your point total will never be reduced below zero.

Points are subtracted one year after:

  1. your last point violation; or
  2. your license was restored; or
  3. the last time annual safe driving points were subtracted from your record (whichever is later); or
  4. after you complete an MVS driver improvement program, offered to problem drivers selected by MVS.

Credit is given for a maximum of one program every two years.

Up to two points may be subtracted from your total after you complete an MVS approved defensive driving course. Credit is given for one program every five years.

5. When will the MVS remove points from my driving record?

THREE WAYS POINTS CAN BE REDUCED AND/OR DEDUCTED:

  1. For every year of safe driving, three points will be deducted from your license.
  2. A driver can take a driving improvement program, and three points can be subtracted from your license. These programs must be approved by the MVS, and credit can only be give for one program maximum every two years.
  3. A driver can complete a MVS approved defensive driving courts. After the driver completes this course, then two points will be subtracted from their license. A driver can only take one program every five years.

* If you receive a Notice of Suspension from the MVS, Call the Law Office of Theodore Sliwinski, Esq. immediately to find out how he can save your license, and keep you on the road so that you can get to work?
