FAILURE TO REPORT AN ACCIDENT

OVERVIEW

A driver who is involved in a motor vehicle accident that results in personal injury or property damage in excess of $500, must notify the police of the accident. Moreover, the driver must submit a written report of the accident containing information on the cause, condition, and persons and vehicles involved within 10 days after the accident to the MVS.

A driver who is convicted of this offense is subject to a fine of $32 to $102. This offense is not a point violation. This charge is a lesser-included offense, of leaving the scene of the accident. If a driver retains a good lawyer, many times a leaving the scene of the accident will be downgraded to failure to report an accident.
