SECOND SERIOUS TRAFFIC VIOLATION COMMITTED BY A CMV

OVERVIEW

A driver who commits a serious traffic violation while operating a commercial motor vehicle will face the ordinary penalties for the violation. If the driver’s basic driving privileges are suspended, then the driver’s CDL are also suspended. If the driver is convicted of any serious traffic violation while operating a CMV within the next three years, the court must suspend the driver’s CDL for a period for at least 60 days in addition to any other penalty imposed for the conviction. A court must also suspend a driver’s CDL for 120 days if the conviction constitutes the driver’s third or subsequent serious traffic violation committed in a lCMV within a three-year period.
